By accessing this website or engaging Berkeley Deck & Fence for services, you agree to be bound by these terms and conditions. If you do not agree, please do not use this website or engage our services. These terms apply to all visitors, clients, and anyone else who interacts with Berkeley Deck & Fence through this website or directly.
Berkeley Deck & Fence provides residential and commercial deck construction, fence installation, and related outdoor improvement services in Berkeley, CA and surrounding communities. Services are performed by appointment only. This website is for informational purposes and to facilitate initial contact - it does not constitute a binding service contract.
All estimates are provided in writing and are valid for 30 days from the date of issue unless otherwise noted. An estimate is not a final contract. Work begins only after both parties sign a written service agreement that specifies the scope, materials, price, and schedule.
Actual costs may vary from the estimate if unforeseen conditions are discovered during the project - such as rot, structural damage, or utility conflicts not visible before work began. In those situations, we will notify you before proceeding and provide a written change order for your approval. No additional work will be performed without your written authorization.
Project start dates are confirmed in writing in your service agreement. We make every reasonable effort to begin and complete work on the agreed schedule. Delays caused by weather, permit processing, material lead times, or circumstances outside our control are not grounds for contract termination or fee reduction.
If you need to reschedule or cancel a project after a service agreement is signed, please notify us as soon as possible in writing. Cancellation terms - including any deposits that are non-refundable - will be specified in your service agreement.
Payment schedules are set out in the signed service agreement and typically include a deposit at project start, a progress payment at a defined milestone, and a final payment upon completion. Final payment is due at project completion unless otherwise agreed in writing.
Invoices not paid within the timeframe specified in your service agreement may be subject to a late fee as stated in that agreement. Berkeley Deck & Fence reserves the right to suspend work on a project where payment is past due.
For projects that require a building permit, Berkeley Deck & Fencewill apply for and manage the permit process on your behalf unless otherwise agreed. Permit fees are the responsibility of the client and will be itemized in the written estimate.Berkeley Deck & Fence will schedule and attend all required inspections. Final project completion is contingent on passing all required inspections.
Berkeley Deck & Fence warrants that all work will be performed in a workmanlike manner consistent with applicable building codes and industry standards. Specific warranty terms for labor will be set out in your service agreement.
Material warranties are provided by the manufacturers and are passed through to you. We do not independently warrant materials beyond what the manufacturer covers.
This warranty does not cover damage caused by misuse, neglect, failure to perform recommended maintenance, acts of nature, vandalism, or modifications made by others after project completion.
To the fullest extent permitted by law, Berkeley Deck & Fence will not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to the services provided or the use of this website.
Our total liability to you for any claim arising from a project will not exceed the amount you paid Berkeley Deck & Fence for that specific project. This limitation applies regardless of the legal theory under which a claim is brought.

If the dispute cannot be resolved through direct communication, it shall be submitted to binding arbitration in Berkeley, CA in accordance with the rules of the American Arbitration Association. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
These terms and conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising under these terms that is not subject to arbitration shall be brought in the courts of California.
We reserve the right to update or modify these terms at any time. When changes are made, we will update the effective date at the top of this page. Your continued use of this website or engagement of our services after changes are posted constitutes acceptance of the updated terms.
